How the Probate Process Works
In most Probate matters, court procedures, require the involvement of a lawyer to assist with the Probate process and properly administer real estate.
Probate administration in Illinois may be handled in one of two ways:

Supervised Administration – The court closely oversees all actions taken by the Executor or Administrator. This is more common in contested cases or when disputes arise.

Independent Administration – Allows the Executor or Administrator to act with minimal court involvement. This option is often elected in a Will and provides greater efficiency unless an interested party requests court supervision.
Why Is Probate Necessary?
Probate is often required when a loved one owned asset solely in their name at the time of their passing. Even if a valid Will exists, financial institutions and lenders generally will not release assets without a court order appointing an Executor or Administrator.
